KATHMANDU: The Supreme Court has rejected former Nepali Congress president Sher Bahadur Deuba’s request to halt the party’s 15th General Convention being organized by the central committee led by Gagan Kumar Thapa, elected through a special convention.
A joint bench of Justices Sharanga Subedi and Nripdhwaj Niraula ruled that the court’s earlier order could not be amended as demanded by Deuba to stop the 15th General Convention.
Deuba had filed a petition seeking correction of the Supreme Court’s April 17, 2026 order, arguing that the decision recognizing Thapa needed to be rectified.
The earlier order had referred to the central committee being promoted as the “Nepali Congress Central Working Committee” under the chairmanship of Gagan Kumar Thapa, who was said to have been elected through an “unconstitutional special convention.”
The Supreme Court, however, said the details included in the order were based on the names, addresses and positions of the parties mentioned in the writ petition and the information provided by the respondents in their written responses.
The court further clarified that, while issuing a final order or verdict, it would assess the writ petition, responses from the respondents and submitted evidence as a whole. There is no mandatory requirement for an order or verdict to reproduce the details exactly as stated in the petition or plaint.
The Supreme Court therefore concluded that the order could not be amended as requested by Deuba and directed that the matter be dealt with according to law.
